Funding for public education is a state’s duty To the Editor: It is NOT the Federal Government’s obligation to establish or fund public education. Article 1, Section 8 of the U.S. Constitution lists the powers of the Congress, and establishing and funding public education is not one of those powers. The 10th Amendment to the U.S. Constitution grants power to the states and the people for any powers not delegated to the United States by the Constitution.
