Area man cited for disorderly conduct at Kish Creek

LEWISTOWN — Harold L. Foltz, 47, address unknown, was cited for disorderly conduct after Lewistown Police Department officers received a complaint about a homeless male living under the bridge at Kish Creek and the Business Route 22 overpass in Lewistown, who was making statements that he was going to “gut someone” at 6:39 p.m. on April 30, according a release issued on Thursday. Officers said they contacted Foltz who denied making these statements and said that he was looking for “artifacts.” Foltz has an extensive history of this type of conduct and has repeatedly refused services offered to him.

Man charged with simple assault

LEWISTOWN — Lewistown Police Department officers responded to West Third Street and North Grand Street in Lewistown for a hit-and-run crash that was later determined to be a domestic dispute at 9:21 a.m. on May 1, according to a release issued on Thursday. Witnesses reported a maroon Ford SUV struck a parked car, and a male passenger was observed trying to pull the female driver out of the vehicle. The male then fled northbound on North Grand Street and the female driver fled from the scene, police said, and officers were provided with a license plate number and located the male and female at their residence on West Sixth Street. The male was identified as Clair C. Setzler, 73, of Lewistown, and the female reported that Setzler was pulling on her arm while she was driving which caused her to crash. Setzler continued attempting to pull on the female before fleeing on foot, and the female had several fresh, bloodied bruises on her arm consistent with having been pulled and gripped by a hand. Setzler denied the accusations, but he was placed under arrest and transported to the Mifflin County Correctional Facility in Lewistown where he was charged with simple assault and recklessly endangering another person.

Police investigate animal abuse claim

LEWISTOWN — Lewistown Police Department officers received a complaint from an animal rescue in Centre County regarding animal abuse at 4 p.m. on May 1, according to a release issued on Thursday. A landlord contacted the rescue after a tenant at a residence on the 400 block of West Fourth Street in Lewistown left two dogs caged inside a residence for days without access to food or water. Police said one dog was showing signs of being malnourished, as an LPD officer trained in investigating animal cruelty cases is investigating this report. Criminal charges are pending receiving an examination report from the rescue organization as well as positively identifying the tenant responsible for providing care for the animals.

Overnight school janitor charged with possession of controlled substance

LEWISTOWN — Lewistown Police Department officers were dispatched to Mifflin County Middle School in Lewistown at 8:32 p.m. on May 1 for a report of an overnight janitor who was in possession of crack cocaine, according to a release issued on Thursday. A supervisor reported that the janitor had alcohol on the property, which is a violation of their policies, the report said. The superintendent responded and was given consent by the employee, who was identified as Kenneth A. Fitzpatrick, 41, of Sewickley, to search his belongings and his person, the report said, and in addition to locating alcohol in Fitzpatrick’s possession, the superintendent also located a baggy of crack cocaine in Fitzpatrick’s back pocket. Fitzpatrick was charged for possession of a controlled substance, police said.

Lewistown man charged with strangulation

LEWISTOWN — An 18-year-old Lewistown man was lodged in the Mifflin County Correctional Facility in Lewistown and charged with strangulation and simple assault after an alleged domestic assault on the first block of South Main Street in Lewistown at 12:42 a.m. on May 2, according to a release issued by the Lewistown Police Department on Thursday. Jayden L. Fisher called 911 to report a domestic dispute, but the dispatcher heard a female in the background yelling that Fisher strangled her, police said. Officers located a juvenile female nearby and received statements from both parties. The juvenile was previously in a relationship with Fisher and is pregnant with twins of whom Fisher acknowledged being the biological father to. The juvenile came to Fisher’s apartment to confront him about being in a relationship with another female. The female reported that Fisher answered the door and grabbed the juvenile by the throat dragging her down a flight of steps while maintaining a grasp on her throat. This prevented her from breathing. Fisher dragged the female outside and was pushed by the female into a door which broke a glass pane.

The female claimed Fisher told her to punch him so she struck him twice in the face when they were outside. Fisher reportedly made a comment that he took it “like a champ.” Fisher provided a statement that he escorted the female down the steps by her shoulders and that she punched him and pushed him into the glass in the door, police said.

Police investigating scam involving sale of Jeep vehicle

LEWISTOWN — A Lewistown resident who attempted to purchase a 2021 Jeff with low mileage for $2,500 contacted the Lewistown Police Department after realizing it might have been a scam at 6:11 a.m. on May 2, according to a release issued on Thursday. The seller requested a down payment paid in Apple gift cards. The resident sent a payment of $850 and the seller wanted more money for a delivery driver fee. Officers reviewed the profile and recognized it to be a scam based upon a large inventory of vehicles listed well below their retail values. Additionally, the pictures of the vehicles purported to be from the seller’s car lot appeared to have varying backgrounds and were not photographed from the same property. The language used by the seller suggested that they were from another country, police said.

Surveillance video to determine charges for fight

LEWISTOWN — Lewistown Police Department officers responded to the area in front of the Major League Bottle Shop, 135 Logan St., Lewistown, for a fight between several people at 1:19 a.m. on May 3, according to a release issued on Thursday. Officers located two parties who provided various statements: A group of three people (ages 43, 18 and a juvenile) showed up to the bar to get the father of their child to return home to care for the child. An altercation erupted regarding a female who was out at the bar with the father. An altercation ensued with each party claiming the other started the physical fight. Minor injuries were reported and officers are waiting for surveillance video from the bar to determine which party started the altercation as well as determining what charges are applicable.

Granville Township man trespassed from convenience store

LEWISTOWN — Lewistown Police Department officers responded to Sheetz, 113 N. Juniata St., Lewistown, for a report of retail theft at 6:32 a.m. on May 3, according to a release issued on Thursday. Store officials reported that a male was in the store a few hours prior and took a cup and a bottle of wine and left without paying for them. Store employees confronted the male who said he would return later to pay for it and he failed to do so. The subject returned around 6:30 a.m. wearing the same clothing and left the store. Officers located the subject nearby and he was identified as Bradley J. Herbster, 38, of Granville Township, and he told officers that another person was supposed to have paid for the alcohol. Herbster was trespassed from the store and charges for retail theft are pending the receipt of surveillance video, police said.

Woman charged with simple trespassing

LEWISTOWN — An 18-year-old Lewistown woman was cited for simple trespassing by Lewistown Police Department officers after a trespassing complaint at the apartment complex located at 20 S. Main St., Lewistown, at 9:09 a.m. on May 3, according to a release issued on Thursday. Police said a resident reported that between 3 to 4:30 a.m., a jealous ex-girlfriend and two others broke in his door in an attempt to confront a female sleeping inside. Officers spoke with Jaylyn M. Wagner on the phone and later followed up with the ex-girlfriend who provided a statement. Subjects indicated that the ex-girlfriend went to the apartment to confront the female. The ex-girlfriend was banging on the door and pushing it. Police said Wagner sat on the ground and pushed her back off a wall with her feet on the door. Wagner broke the door and then crawled in through the hole. The three females went inside and confronted the female who was sleeping in a bedroom. The caller only wanted Wagner charged.
