PORT ROYAL -- An East Waterford man faces felony burglary and assault charges after state police say he attempted to enter a Tuscarora Township residence and was shot by the homeowner Tuesday night.
Terry L. Burdge, 45, was with first-degree felony burglary, second-degree felony aggravated assault, misdemeanor simple assault and summary criminal mischief in connection with the Oct. 13 incident.
According to court documents filed by Pennsylvania State Police at Lewistown, troopers were dispatched at approximately 11:23 p.m. to a residence along Laughlin Lane after receiving a report of a possible gunshot.
Police said the home owner contacted authorities after hearing what he believed was a gunshot near his residence on David Street in Tuscarora Township.
Shortly afterward, Juniata County 911 received a call from someone who reported that he had shot Burdge at his residence on Laughlin Lane after Burdge allegedly attempted to enter the home through a porch on the southern side of the property.
When police arrived, Burdge was receiving medical attention from Lack-Tuscarora EMS personnel for an apparent gunshot wound.
Investigators recovered a spent ammunition casing, a screwdriver and a blue cap belonging to Burdge from the porch, according to the affidavit of probable cause.
Police also located a gray Kia Seltos registered to Burdge at the scene.
Police observed damage to a doorway on the southern side of the residence that appeared to have been forced open. Investigators also documented damage to drywall inside the home consistent with the door being forced open and a doorknob striking the wall.
Irvin told investigators the firearm used in the shooting was on a couch in the living room. Police recovered a .380-caliber pistol.
Burdge was transported by emergency medical services to Penn State Health-Holy Spirit Medical Center for treatment of a gunshot wound to the chest.
The affidavit states that Burdge also allegedly struck a Lack-Tuscarora EMS employee in the face with a closed fist while emergency personnel were attempting to provide medical care.
During an interview with state police on Oct. 14, the home owner said he had been lying on his living room couch the previous evening when he heard shouting and banging outside his home.
The home owner told police he retrieved a firearm and walked toward the southern entrance, where he discovered the door had been broken open.
According to court documents, Irvin reported seeing Burdge standing in the doorway with his fists clenched and appearing angry.
The home owner told investigators Burdge said he was going to “teach you a lesson.”
Police said Irvin reported that Burdge then took a step toward him, prompting Irvin to fire a single round that struck Burdge in the chest.
Irvin told investigators he believed Burdge would have beaten him had he not fired the weapon.
A criminal complaint was filed Oct. 14 before Magisterial District Judge Joshua R. Imes.
Burdge was arraigned Friday, Oct. 16, and bail was set at $300,000. According to court records, he was committed to the Mifflin County Correctional Facility after being unable to post bail.
A preliminary hearing is scheduled for 9 a.m. Thursday, Oct. 22, before Imes.
