Two charged in Kish Park tent fire
LEWISTOWN — Two men are facing felony arson charges after authorities allege one of them set fire to a tent at Derry Park while the other supplied the torch lighter used to ignite it following a dispute among campers.
Colin Wayne Herman, 29, of Lewistown, and Whitney Wilson Heaps, 42, of York, each face felony arson and misdemeanor criminal mischief charges stemming from the June 29 fire at the campground in Derry Township. Heaps also is charged with false reports to law enforcement and three drug-related offenses. Both men were unable to post $50,000 bail and are being held at the Mifflin County Correctional Facility. Preliminary hearings for both are scheduled for July 8 before Magisterial District Judge Eric Ettinger.
According to affidavits filed by Mifflin County Regional Police Department, officers responded about 5 p.m. Monday to reports of a tent fire at Kish Park. After firefighters extinguished the blaze, investigators found the tent and numerous personal belongings had been destroyed, including clothing, a rented Xbox gaming console, a laptop, a speaker, headphones and prescription medications. The victims also reported paying $210 to rent the campsite for the week.
Police said the campers told investigators they had not stayed at the campsite the previous night and identified Herman, Heaps and Clarissa Laub as the last people known to have occupied the tent. Officers later located Herman, Heaps and Laub beneath the U.S. 322 bridge on Walnut Street in Lewistown.
According to court documents, Herman initially denied knowing how the fire started but later admitted igniting the tent with an orange torch lighter after Heaps and Laub removed their belongings. Herman told investigators he set the fire because of an ongoing disagreement involving the campers. Police said Herman also alleged that Heaps provided the lighter and was involved in the decision to burn the tent.
Investigators said Heaps admitted giving Herman the torch lighter and acknowledged he was present when the fire occurred, although he told officers he was walking away from the area at the time. Police also allege Heaps falsely told investigators he knew nothing about the fire during the initial interview.
During a search following Heaps’ arrest, officers said they recovered an orange torch lighter, marijuana not contained in its original prescription packaging, a glass smoking device and a pocket knife.
Authorities allege the fire was intentionally set following a disagreement between Heaps, Laub and the campers whose belongings were destroyed.
