MIFFLINTOWN -- A 35-year-old man is facing nearly 130 charges related to sexual assaults that occurred in 2008.
Brian Timothy Wagner, of Mifflintown, was arraigned before Magisterial District Judge Jacqueline Leister Tuesday on 25 felony counts of statutory sexual assault, 25 felony counts of involuntary deviate sexual intercourse of a person less than 16, 25 counts of corruption of minors, 25 felony counts of aggravated indecent assault on a person less than 16, 25 counts of misdemeanor indecent assault on a person less than 16, and one count of felony rape.
According to the Affidavit of Probable Cause filed by Pennsylvania State Police, the victim reported in May of this year that, at age 13 -- between June 2008 and July 2009 -- she engaged in a physical relationship with Wagner, who was then 20 years old.
During this time, the victim stated that Wagner performed various sexual acts on her about 25 times and that they would watch videos together so that she would "learn what to do," the affidavit states.
According to court documents, after a series of events, the victim reportedly wanted out of the relationship and tried to make the alleged assailant end the relationship. Shortly thereafter, when she was home alone, she said Wagner came into her house, entered her bedroom and forcibly raped her.
In an interview with police, Wagner confirmed having "consensual" sex with the victim on more than one occassion, but did not recall forcibly raping her.
Wagner is being held without bail at Mifflin County Correctional Facility, awaiting a preliminary hearing set for 10:30 a.m. Thursday in Leister's office.
