MIFFLINTOWN -- A Juniata County man has been charged with statutory sexual assault and other related charges after police said he had sex with a 14-year-old this past November in Fermanagh Township, according to an affidavit of probable cause filed Monday by Pennsylvania State Police Lewistown.
After being informed of a possible instance of child abuse by Juniata County Children and Youth Services, police said they interviewed two witnesses who claimed to be present while 21-year-old Austin Tyler Spickler, of Mifflintown, and a 14-year-old were having sex at a barn after drinking alcohol.
One witness told police they saw Spickler and the teen having sex in the bathroom before the two moved to another area of the building where they were again spotted having sex by the witness, who admitted Spickler, the teen and the two witnesses had all been drinking alcohol that evening, according to the affidavit.
The other witness told police Spickler admitted to them he had sex with the teen but did not know the teen's age until afterward, according to the affidavit.
The teen told police they and Spickler stopped because the two witnesses came into the room and said they had to leave because it was 5:30 a.m, according to the affidavit.
Spickler denied having sex with the teen when interviewed by police and said that while he was present at the time, he waited in the car until while the teen and the two witnesses went into the barn, according to the affidavit.
Spickler faces charges of statutory sexual assault, corruption of minors, unlawful contact with a minor and indecent assault of a person less than 16 years of age.
He is currently lodged in the Mifflin County Correctional Facility, unable to post the $100,000 bail set. His preliminary hearing is scheduled for 9:30 a.m. Feb. 23 before Magisterial District Judge Tracy L. Powell in Mifflintown.
