Mifflintown man jailed after domestic dispute

MIFFLINTOWN — A 32-year-old man was arrested after police said he illegally discharged a firearm in an occupied structure.

Lawson Kyle Hendricks of Mifflintown, was arraigned before Magisterial District Judge Fredrick Cabell Jr. on March 8 in two separate court filings. Hendricks’ first set of charges included discharging a firearm into an occupied structure, reckless endangerment, simple assault, disorderly conduct, harassment and public drunkenness. In a second set of charges, Hendricks was cited with aggravated assault and resisting arrest.

According to the Affidavit of Probable Cause, on March 7, at approximately 7:30 p.m., Pennsylvania State Police at Lewistown responded to an incident occurring between 25 and 59 Dolan Heights Road, Milford Township, in Juniata County.

Police stated that Hendricks was “outside yelling at his girlfriend’s mother.”

The affidavit states that prior to this incident, police had responded to a domestic incident at Hendricks residence, in which Hendricks was “observed to be manifestly under the influence of alcohol and was advised to stay in his home for the rest of the night.”

Upon arriving on scene, responding officers observed a “brown and black 760 Pumpmaster Classic BB Gun” with no serial number, lying on a hot tub located outside of the 25 Dolan Heights Road residence, pointing towards the 59 Dolan Heights Road residence.

A witness told police that Hendrick used the BB gun to shoot at the 59 Dolan Heights Road residence.

The BB gun was obtained and Hendricks was placed under arrest.

During an interview with a witness, police were informed that the couple had engaged in a domestic dispute that night. Hendricks drank “approximately ¾ of a bottle of Jagermister liquor” and the argument was caused by “ongoing criminal and children and youth investigations.”

Police said Hendricks was upset with his girlfriend’s parents’ involvement with the ongoing investigations and began shining a spotlight at their residence (59 Dolan Heights Road).

The witness said Hendricks walked up Dolan Heights Road and engaged in an argument with, before returning to his residence, retrieved the BB gun, and fired it toward the 59 Dolan Heights Road residence “approximately 3 to 4 times” and said to “something to the affect of ‘you will be the one to pay for this.”

Police interviewed the parents, who shared they had called the police for the original domestic dispute because the kids had said “their dad was being mean to their mom.”

Police said Hendricks admitted to verbal arguments, but denied pointing a spotlight and firing a BB gun at the 59 Dolan Heights Road residence.

Hendricks became uncooperative during fingerprinting, resulting in the second set of charges filed against him, which included aggravated assault and resisting arrest.

According to the Affidavit of Probable Cause, at approximately 10:30 p.m. Hendricks was being processed by officers without any restraints and “refused to face the camera and hold his head straight.” The officers advised Hendricks to cooperate to which he continued to refuse.

Police then told Hendricks to stand up to which he responded “good luck with that.”

At that time, officers attempted to secure Hendricks in handcuffs. He “held his arms to his chest and clenched his fists” resisting arrest.

One of the officers involved was able to place one handcuff on Hendricks, to which Hendricks reacted by “shoulder checking” that officer.

Hendricks was “taken to the ground” where he continued to “thrash around and refuse to be handcuffed.”

Hendricks was assisted to the patrol room bench while he continued to “kick and shoulder-check police.”

Hendricks has since been charged with two felonies, five misdemeanors, and one summary offense. He is being held at Mifflin County Correctional Facility unable to post $600,000 bail – $300,000 for each set of charges.

Hendricks is awaiting a preliminary hearing set for 10:30 a.m. March 12 and his hearing for the second arrest is set for 10 a.m. March 13. Both hearings will be held before Magisterial District Judge Fredrick Cabell Jr.
