Two charged with burglary

Charges pending for accomplices

LEWISTOWN — Two men were each charged late Friday night with two counts burglary and two counts criminal trespass, after a police investigation determined they and a female accomplice unlawfully entered a Lewistown residence in September, court documents indicate.

Documents state that Cody S. Hummel, of McClure, and Gregory S. Allenbaugh, 26, of Reedsville reportedly met with Melissa M. Nale, 25, of Milroy, at a local bar on Sept. 30 and attempted to lure, via social media, the owner of a Fifth Street residence to the bar, in order to confront the owner over past disputes. When they were unsuccessful, the three went to the residence to confront the owner, court documents state.

The accuser told police that he was upstairs when he heard a loud knocking, which he believed was a friend that had been staying at the residence. Documents state the accuser unlocked the door, that he was struck in the face once it opened before immediately shutting the door with force and re-locking it. He reported hearing Nale encouraging someone to inflict bodily harm on the owner.

The accuser reportedly went upstairs to retrieve a firearm and advised another person in the residence to call the police. The window downstairs was broken and both Allenbaugh and Hummel entered the residence by unlocking the door, court documents indicate.

According to court documents, the accuser gave Hummel and Allenbaugh several orders to leave while pointing the gun at the men. Allenbaugh reportedly grabbed the barrel of the firearm in an attempt to disarm the accuser and Hummel verbally indicated the accuser would not shoot.

Documents indicate the accuser pulled the trigger, however both Allenbaugh and Hummel overpowered and assaulted him before Hummel exited the residence, claiming he had been shot. The accuser reported being struck in the face multiple times by Allenbaugh before he also exited the residence, documents state. The accuser reportedly chose to wait at the residence for arrival of police.

Documents state that both the accuser and Hummel were treated at Geisinger-Lewistown Hospital for their injuries and Hummel was transferred to Hershey Medical Center, where police interviewed him about the incident. Hummel stated that he did not remember being inside the accuser’s home and was not able to recount most of the incident. A blood draw concluded Hummel’s blood alcohol content was .22 and a medical examination determined that while Hummel did not sustain any gunshot wounds, he did sustain severe lacerations on the upper right arm.

Nale told officers that she kicked the bottom of the residence door to get the owner’s attention, that Hummel placed his foot inside the doorway to prevent the owner from closing the door and that Hummel raised his arm when the door was closing, causing the window to break, court documents state. According to court documents, Nale further told police that she was on the enclosed porch when Hummel and Allenbaugh attempted to enter the residence, but that she may have “blanked out” because of the trauma. Police reported that Nale had posted to social media the day before the incident in a threatening manner.

Court documents state Allenbaugh admitted to police that he engaged in a physical altercation with the accuser and that he and Hummel were inside the residence.

Charges were filed against Hummel, Allenbaugh and Nale, Friday. Hummel was arraigned before Magisterial District Judge Jonathan Reed on Friday and Allenbaugh was arraigned on Monday, both for a total of seven criminal counts each. Reed set bail at $150,000 each and both were committed to Mifflin County Correctional Facility, unable to post bail. Hummel is scheduled for preliminary hearing tomorrow and Allenbaugh is scheduled on Oct. 31. Nale has seven criminal conspiracy counts pending.
