Local woman sentenced to 23 months county incarceration

LEWISTOWN — Brittney L. Marshall, 27, was sentenced Friday by President Judge David Barron to a minimum of 11 1/2 and a maximum of 23 months incarceration in Mifflin County Correctional Facility, after pleading no-contest in February to one felony count endangering the welfare of a child.

Documents state that Marshall, of Burnham, was charged in June after an EMT working for Fame EMS reported to police seeing a small child crawling out of a second-floor window onto the roof and back inside, several times, at Marshall’s Fourth Avenue residence. Prior to the incident, a neighbor reportedly called police regarding a small child walking naked and pushing a toy lawnmower in the middle of Fourth Avenue, according to court documents.

According to documents, when police asked Marshall why the child was in the street, naked and unsupervised, they reported that Marshall said the child’s 10-year-old sibling was supposed to be providing supervision.

Public Defender Robert Ferguson requested that Marshall be sentenced on the low-end of the sentencing guidelines, particularly because the children were still in Marshall’s custody and that Mifflin County Children and Youth Services has made no action to remove the children. District Attorney Christopher Torquato advised Barron that the child is in supervised custody and that Marshall has a previous conviction of the same offense.

In addition to Marshall’s incarceration, Barron sentenced financial responsibility to pay the costs of prosecution and a $300 fine. Marshall was also deemed eligible for work release while

incarcerated.
